Acceptance of Terms

Welcome to Brixi ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access and use of our platform, website, and related services (collectively, the "Services"). By using our Services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. Your continued use of the service constitutes acceptance of any updates to these terms.

1. Description of Service

Brixi provides an AI-powered customer relationship management (CRM) platform that includes lead scoring, sales forecasting, automation tools, analytics capabilities, property listing management, and third-party integrations including LinkedIn Sales Navigator, Meta Business, and other lead generation platforms. The service is provided "as is" and we reserve the right to modify or discontinue the service at any time with reasonable notice.

2. User Accounts and Authentication

To use our service, you must:

  • Provide accurate and complete registration information when creating your account
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized use or security breaches
  • Take responsibility for all activities that occur under your account
  • Ensure you have proper authorization before connecting any third-party accounts
  • Comply with the terms of service of all integrated platforms (Google, Microsoft, LinkedIn, Meta, etc.)
  • Maintain the security of your connected third-party accounts (Google, Microsoft, etc.) and accept responsibility for any activities that occur through our OAuth integration
  • Use email and calendar features responsibly and in compliance with all applicable laws and third-party terms of service

3. Third-Party Integrations and Lead Sync

Our service integrates with third-party platforms including LinkedIn, Meta (Facebook, Instagram), and other lead generation services. By connecting third-party services (Google, Microsoft, LinkedIn, Meta, etc.), you authorize us to access your email, calendar, and leads data on your behalf for lead management and communication purposes. By using these integrations, you acknowledge and agree that:

  • You must comply with all applicable terms of service and privacy policies of integrated platforms
  • You are solely responsible for obtaining proper consent from leads before data collection
  • Lead data syncing is subject to rate limits and API restrictions of third-party platforms
  • We are not responsible for interruptions or changes to third-party APIs
  • You must not use automated tools or bots that violate platform policies
  • All marketing activities must comply with CAN-SPAM Act and similar regulations

4. Payment Terms and Billing

Subscription fees are billed in advance on a monthly or annual basis. Additional charges may apply for premium features, API usage overages, or third-party integration costs. All fees are non-refundable except as required by law or in cases of service non-delivery.

  • We reserve the right to change pricing with 30 days advance notice
  • Failed payments may result in service suspension
  • Refunds are processed within 7-14 business days to the original payment method
  • Enterprise customers may have custom billing arrangements

5. Acceptable Use Policy

You agree not to:

  • Use the service for illegal purposes or spam activities
  • Attempt to gain unauthorized access to our systems or data
  • Interfere with or disrupt the service or connected platforms
  • Upload malicious code, viruses, or harmful content
  • Violate any applicable laws, regulations, or platform policies
  • Engage in deceptive or fraudulent lead generation practices
  • Scrape or harvest data without proper authorization
  • Share login credentials or allow unauthorized access
  • Use the service to compete directly with Brixi
  • Upload or distribute property information that violates third-party rights or misrepresents property details

6. AI Use and Responsibility

Our Services include AI-powered features designed to assist with:

  • Lead management and CRM automation
  • Email composition and personalization
  • Document analysis and processing
  • Property recommendation generation
  • Sales forecasting and predictive analytics
  • Lead scoring and qualification

By creating an account and using our AI-powered features, you acknowledge and agree that:

1. You are fully responsible for any decisions made based on AI-generated content.

2. Brixi is not liable for any outcomes, errors, or losses resulting from the use of AI-generated content.

3. AI-generated content is provided for informational purposes and should be reviewed and validated by a humanbefore acting on it.

4. AI outputs may contain inaccuracies, biases, or incomplete information that require human oversight and judgment.

You accept that proper oversight is necessary when using AI-driven outputs and that they are intended to assist, not replace, human judgment in business decisions, communications, and customer interactions.

7. Data Protection and Privacy

As a CRM platform handling personal and business data, we are committed to data protection:

  • All data is encrypted in transit and at rest
  • You retain ownership of your customer and lead data
  • You are responsible for obtaining proper consent for data processing
  • You can request data export or deletion at any time
  • We maintain appropriate technical and organizational measures for data security
  • Third-party data processors are bound by appropriate data protection agreements

8. Property Listings and Content Responsibilities

Brixi is a customer relationship management (CRM) platform designed to help organize and share property-related information. The following responsibilities apply when using the platform:

For Property Buyers and End Customers

  • Independently verify all property details, pricing, approvals, and representations before making any purchase or financial decision
  • Conduct due diligence, including verification of ownership, legal status, approvals, and RERA registration where applicable
  • Not rely solely on information shared through Brixi for final decision-making

For CRM Administrators and Platform Users

  • Ensure all property information uploaded or shared is accurate, complete, current, and not misleading
  • Obtain proper authorization before listing, advertising, or sharing any property-related content
  • Comply with all applicable real estate laws and regulations, including the Real Estate (Regulation and Development) Act, 2016 (RERA)
  • Maintain accurate records of property documentation, approvals, and compliance details
  • Update or remove property information promptly when details change or properties become unavailable

Brixi does not verify, validate, audit, or guarantee the accuracy, completeness, or legality of any property-related information shared on the platform. All data is provided by CRM users and may be inaccurate, outdated, or incomplete. Brixi expressly disclaims any responsibility or liability arising from reliance on such information.

9. Termination and Data Retention

We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination:

  • You will have 30 days to export your data
  • Data will be permanently deleted after 90 days unless legally required to retain
  • Third-party integrations will be disconnected immediately
  • Refunds may be provided for prepaid unused services at our discretion

10. Limitation of Liability

In no event shall Brixi be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. Our total liability is limited to the amount paid by you in the 12 months preceding the claim.

We are not responsible for third-party platform changes, API limitations, or data accuracy from external sources. Lead generation results are not guaranteed and depend on various factors beyond our control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Compliance and Regulatory Requirements

Users must comply with all applicable laws and regulations including:

  • CAN-SPAM Act, GDPR, CCPA, and other data protection regulations
  • Telephone Consumer Protection Act (TCPA) for phone communications
  • Real Estate (Regulation and Development) Act 2016 (RERA) where applicable
  • LinkedIn User Agreement and Professional Community Policies
  • Meta Terms of Service and Community Standards
  • Industry-specific regulations applicable to your business sector
  • Anti-spam and telemarketing laws in your jurisdiction

Amendments and Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the service after changes constitutes acceptance of the new terms. If you disagree with changes, you may terminate your account before the effective date.
